What a Missouri Unemployment Appeal Hearing Is Like
Most first-level hearings are recorded phone or video hearings of 30-60 minutes. It is run by An Appeals Referee of the DES Appeals Tribunal hears first-level appeals. The regulations also call this person the “hearing officer” (RSMo 288.190; 8 CSR 10-5.010).; you and the employer each testify, answer the officer’s questions and can question each other’s witnesses. Parties may bring witnesses to testify.
If a witness refuses to take part, you can ask the referee named on the hearing notice in writing for a subpoena. Send it early and include the witness’s name or a list of the documents you need. The person asking for the subpoena is responsible for having it served (8 CSR 10-5.015).
