Getting an Indiana Unemployment Overpayment Waived
Under IC 22-4-13-1(i), DWD may waive part or all of an overpayment if you were not at fault and repayment would be contrary to equity and good conscience. DWD’s FAQ treats repayment as contrary to equity and good conscience when household income is 65 percent or less of the Federal Poverty Guidelines. DWD can also intercept Indiana state tax refunds, lottery winnings, and federal tax refunds through the Treasury Offset Program (TOP). A TOP notice gives you 60 days to resolve or dispute the debt.
