Iowa Workforce Development (IWD) treats an overpayment as non-fraud when it comes from a reversed decision, an agency or employer error, or a mistake made in good faith. It treats an overpayment as fraud when a claimant knowingly gives false information or holds back a material fact to get benefits (Iowa Code 96.16).
The state generally requires repayment of both types, but fraud adds a penalty, interest, lien fees and a bar on future benefits.

Getting an Iowa Unemployment Overpayment Waived
Iowa generally does not waive regular state overpayments. One exception exists under Iowa Code 96.3(7)(b): the state does not recover the money if there was no fraud or willful misrepresentation, the employer did not take part in the initial decision, and the overpayment comes only from a later appeal reversal about the job separation.
Waivers based on “without fault and against equity and good conscience” applied only to federal CARES Act programs (PUA, PEUC, FPUC, LWA) and never to fraud. Confirm with IWD. Iowa Unemployment Overpayment Repayment Plans and Offsets
If you cannot pay in full, ask the overpayment unit for a repayment plan in writing before the first offset.
For a non-fraud overpayment, IWD may apply up to 100 percent of each future weekly benefit payment until the balance is paid. Benefit payments cannot be used to offset a fraud balance. IWD intercepts state and federal tax refunds through the Iowa Department of Revenue and the federal Treasury Offset Program, plus casino and lottery winnings. It may also use wage garnishment and liens for fraud debts.
Iowa Unemployment Overpayment Penalty Weeks and Fraud Penalties
If you received benefits through misrepresentation, IWD may impose an administrative penalty that makes you ineligible for anywhere from 4 weeks to the end of the benefit year, even after repayment (Iowa Code 96.5(8)). Under Iowa Code 96.5(13), anyone with a fraud overpayment balance (including penalty, interest and lien fees) is disqualified from all benefits until the balance is paid in full. This rule has applied since July 1, 2018.
A 15 percent penalty is added to fraud overpayments (Iowa Code 96.16(4)(b), for determinations issued on or after July 1, 2013). It is collected the same way as the overpayment, but it cannot be taken from future benefits.
