What Counts as Iowa Unemployment Fraud by a Claimant
Under Iowa Code 96.16(1), fraud means knowingly giving false information, or knowingly holding back an important fact, to get or increase benefits. In plain words, that includes not reporting gross wages for the week you earned them, working while claiming without reporting it, sending false work-search reports, and giving a false reason for losing your job. Iowa finds unreported wages through wage crossmatches and new-hire records.
Iowa Unemployment Fraud Penalties and Disqualification
When an overpayment comes from fraud or misrepresentation, the state generally requires repayment of the full amount plus a 15 percent penalty and daily interest (Iowa Code 96.16(4)). Under Iowa Code 96.5(8), IWD may also forfeit benefit weeks for knowing misrepresentation made within the prior 36 months.
The number of penalty weeks is set case by case and can run up to the rest of the benefit year (871 IAC 25.9). Liens and tax refund interception are possible.
