Utah Unemployment Fraud in Your Name: If Someone Else Filed

Getting a Corrected 1099-G
Contact Utah DWS through the fraud channels above and ask for a corrected 1099-G showing 0 in benefits. Utah sends the 1099-G by mail and also posts it in the claimant’s UtahID account. The IRS says that if the corrected form is late, you should still file on time and report only the income you actually received.
The IRS also says Form 14039 is generally not needed for an incorrect 1099-G.
What Counts as Utah Unemployment Fraud by a Claimant
Utah generally treats it as fraud when a claimant knowingly gives false information, or leaves out a material fact, to get benefits. That includes not reporting earnings or work while claiming, giving false work-search reports, and giving a false reason for leaving a job. Filing a claim with someone else’s identity is also listed as claimant fraud (Utah Code 76-8-1301).
Utah Unemployment Fraud Penalties and Disqualification
Most claimants found to have committed fraud must repay the full overpayment plus a civil penalty equal to 100% of the overpayment. This applies to fraud decisions issued on or after July 1, 2004. Penalty weeks are 13 for the first fraud week and 6 more for each additional fraud week (Utah Code 35A-4-405(5); Utah Admin. Code R994-406-403). The Department has no authority to reduce the statutory penalties.
The fraud disqualification is 13 weeks for the first fraud week plus 6 weeks for each additional fraud week, capped at 49 weeks per fraud determination. It begins the Sunday of the week the fraud determination is made (R994-406-403). After that, a claimant generally cannot get benefits or waiting-week credit until the overpayment and penalty are paid in full (R994-406-405).
When Utah Unemployment Fraud Becomes a Criminal Case
Under Utah Code 76-8-1301 (amounts effective May 1, 2024), the charge depends on the total amount obtained or sought. Under 500 is a class B misdemeanor. From 500 to under 1500 is a class A misdemeanor. From 1500 to under 5000 is a third degree felony. 5000 or more is a second degree felony.
Employer-Side Utah Unemployment Fraud
DWS lists employer fraud as a crime, including misclassifying workers and reporting wages incorrectly. SUTA dumping means moving a workforce or business to get a lower unemployment tax rate. Utah Code 35A-4-304 bars it and requires related employers to share their rate experience. Honest Mistakes Are Not Utah Unemployment Fraud
Utah separates fraud, which requires knowing falsehood, from “fault” overpayments. Fault applies when the claimant got benefits they were not owed because of information they could reasonably have given and knew might need reporting (R994-406-301). Fault overpayments are generally repaid without the fraud penalty or the fraud disqualification. If you have a question about the instructions, the state generally requires you to ask DWS before you file the weekly claim.
To fix a weekly claim already filed, confirm the process with DWS.
In fraud cases Utah always issues a warrant, even when the claimant has an installment agreement and is current on the monthly payments (R994-406-404). Every later week paid only because of the original fraud also counts as a fraud week, with its own overpayment, penalty and disqualification time (R994-406-403).
