How Delaware Unemployment Benefits Are Calculated
Delaware adds up the wages from the two highest-paid calendar quarters of your base period and divides that total by 46 (19 Del. C. § 3313). The result is rounded down to the whole dollar and then held between the state minimum and maximum in effect when you file. Delaware has no extra allowance for dependents, so the amount depends only on wages.
Base-period wages of at least 36 times the weekly benefit amount.
Delaware Unemployment Benefits: A Worked Example
Say your two highest base-period quarters paid 9,000 and 9,200, for a total of 18,200. Dividing 18,200 by 46 gives 395.65, which rounds down to a weekly amount of 395, as long as that is within the state maximum for the period. This is only an illustration and not anyone’s actual award; the Division’s written determination sets the real figure.
The estimate is illustrative; Delaware Department of Labor, Division of Unemployment Insurance computes the official amount from your wage records.
How Long Delaware Unemployment Benefits Last
Regular Delaware unemployment benefits run up to 24-26 weeks in a benefit year. Check the current status on the DOL trigger notice at oui.doleta.gov. The first eligible week is a waiting week: you file for it but it is not paid.
Working Part-Time While Claiming Delaware Unemployment Benefits

C. § 3313). the greater of $10 or 50% of the weekly benefit amount Report every dollar on the weekly claim — unreported earnings are the most common route to an overpayment.

You must report severance, vacation pay, holiday pay and pensions on your weekly claim. Under Division guidance, you generally can’t collect benefits for any week covered by severance, even if it was paid as a lump sum. A pension from an employer in your base period is reduced by the part that employer contributed, while a pension from an employer outside the base period does not affect your claim.
Confirm how your payments are treated with the Division, because an adjudicator reviews these claims.
When and How Delaware Unemployment Benefits Are Paid
The first payment usually arrives two to four weeks after filing, once the monetary determination is issued and the first weekly claim is processed. Delaware pays benefits by direct deposit or by a prepaid U.S. Bank debit card, and you pick one when you sign up.
If you don’t choose, the state generally puts you on the debit card, and if you stop direct deposit later you are moved to the card. To enroll, you need a 4-digit PIN, which you set up through TeleBenefits at (302) 761-6576 or 1-800-794-3032. You request benefits for each week you are unemployed, starting with the first week after you open your claim.
You can do this online through WebBenefits or by phone through TeleBenefits. A benefit week runs Sunday through Saturday, and most claimants file on the Sunday after the week ends. What happens if you file late could not be confirmed, so check with the Division of Unemployment Insurance.
Taxes on Delaware Unemployment Benefits
Benefits are taxable federal income, and Delaware generally taxes them too because the state starts from federal adjusted gross income. The only exclusions found were temporary ones for 2020 and 2021. You may choose to have federal tax withheld at 10% (19 Del. C. § 3329). The Division sends Form 1099-G each January for the benefits paid in the prior calendar year.
Your weekly claim asks whether you are still attached to your regular employer, whether you completed your work search log, and whether you are able and available to work. Those answers can affect each payment.
Next step: the amount only matters if you qualify. Our Delaware eligibility guide covers the fired-vs-quit rules and the work-search count, and the application guide walks through filing.
