Illinois treats an overpayment as fraud when benefits were received because the claimant knowingly made a false statement or knowingly failed to disclose a material fact (820 ILCS 405/900 A.1 and 405/901). All other overpayments, such as those caused by agency error, an employer’s successful protest or a misreported earnings mistake, are non-fraud overpayments under 820 ILCS 405/900 A.2. They are collected more gently.

Getting an Illinois Unemployment Overpayment Waived
Under 820 ILCS 405/900, IDES may waive recoupment from future benefits if you ask and the overpayment was received without fault on your part and recovery would be against equity and good conscience. A separate permanent waiver covers non-fault benefits received from March 8, 2020 through the end of the COVID-19 disaster period.
For that one, the waiver request form generally has to be returned within 45 days of its mailing date. Each request is reviewed case by case, so confirm your eligibility with IDES. Illinois Unemployment Overpayment Repayment Plans and Offsets
If you cannot pay in full, ask the overpayment unit for a repayment plan in writing before the first offset.
Unpaid balances are offset against future unemployment benefits, state tax refunds and, through the federal Treasury Offset Program, federal tax refunds.
