Getting an Oregon Unemployment Overpayment Waived
Oregon may waive all or part of an overpayment when collecting it would be against equity and good conscience (ORS 657.317). Overpayments carrying the willful misrepresentation penalty cannot be waived.
Since June 23, 2024, OAR 471-030-0053 waives no-fault overpayments automatically for claimants whose wages over the last 4 quarters were at or below 300 percent of the federal poverty level for a family of four, or who received TANF within 60 days. Other claimants may request a waiver through Frances Online, email, fax or mail. Use Overpayment Waiver Request (Form 129).

Oregon Unemployment Overpayment Repayment Plans and Offsets
Claimants who do not qualify for a waiver may repay in full or ask for a payment plan. To ask, send a message in Frances Online (“I Want To…” then “Send a Message”), use the Contact Us form with the “Overpayment” option, or call Contributions & Recovery. The agency’s overpayment page does not publish a minimum monthly amount, so confirm terms with the agency.
