Able, available and searching: The state generally requires you to be able to work, available for work and seeking full-time work each week you claim. Being available only for part-time work generally isn’t enough. Under Utah Code 35A-4-405(2)(a), you are ineligible if you were fired for “just cause,” meaning conduct connected to the work that was deliberate, willful or wanton and harmed the employer’s legitimate interests. The employer must show three things: culpability, knowledge and control (R994-405-202). Poor performance you couldn’t control, a one-time lapse in judgment or a good-faith mistake generally doesn’t count as just cause, so you may still qualify.

Under 35A-4-405(1) and R994-405-102, good cause means staying in the job would have caused harm you couldn’t control or prevent, judged by how an average person would react, and you had to leave right away.

Examples the state accepts: a definite, immediate offer of another full-time permanent job; an employer requiring you to break the law; work that conflicts with a sincerely held religious or moral conviction; and a compelling personal hardship after you tried reasonable alternatives. Examples it generally rejects: quitting when you could have kept working while you looked for another job, and quitting over a reduction in hours.

A separate “equity and good conscience” exception can also apply.

How long a disqualification lasts. For a quit without good cause, or a firing for just cause, the disqualification starts the week of the separation and lasts until you have worked in covered employment and earned at least 6 times your weekly benefit amount (35A-4-405(1) and (2)(a)). A firing for a crime connected with the work carries a separate 52-week disqualification (35A-4-405(2)(b)).

Self-employed, gig and 1099 work. Generally no. Work done as self-employment can’t be used to qualify for regular benefits. The exception is misclassification: Utah presumes that someone working for pay is an employee, and a 1099 or a contractor label doesn’t settle the question by itself. A worker who believes they were misclassified can ask the department to review their status.

In school or training. Attending school or training doesn’t automatically disqualify you. You must report it on your weekly claim, and you still have to be able, available and looking for full-time work unless the department approves a deferral.
